These Terms of Service ("Terms") govern the use of the WattsIT Analytics website, tools, and SME energy-analysis services ("the Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, stop using the Service.
1. About Our Service
WattsIT Analytics provides data-driven energy analytics for SMEs, including:
- Energy audits
- Interactive analytics dashboards
- Tariff comparisons and cost-saving simulations
- Procurement of electricity quotes from suppliers
- Quarterly updates and ongoing monitoring
All outputs are informational and operational-support tools. They do not constitute financial, legal, engineering, or professional advice.
Paid services (for example, WattsIT Energy Hub or Continuous Monitoring subscriptions) are subject to the pricing disclosed at the time of purchase. Future paid features may be added; updated Terms will be issued when applicable.
2. Responsibilities of SME Users
By using the Service, you agree that:
- You will provide accurate business and energy-related information
- You have authority to submit the SME's data for analysis
- You will not attempt to access or interfere with data belonging to other clients
- You will use the Service in accordance with applicable Irish and EU laws
- You will not copy, reverse engineer, or misuse any part of the Service
- You are responsible for safeguarding any credentials used to access your dashboard or data
You are also responsible for ensuring that any business data uploaded (bills, smart-meter data, equipment lists, consumption details) has been lawfully obtained and may be shared with us.
3. Supplier Quotes and Lead Generation
If you request that WattsIT Analytics procure supplier quotes:
- You authorise us to contact suppliers on your behalf
- You consent to us transmitting only the necessary business and meter information required to generate a quote
- You understand that suppliers become independent data controllers once data is transferred
- You accept that suppliers may contact you directly with quotes or follow-ups
- You acknowledge that we do not control suppliers and are not responsible for their pricing, decisions, contract terms, communications, or behaviour
- Any contract you enter with a supplier is strictly between you and the supplier
4. Data and Privacy
Your data is processed in accordance with our Privacy Policy. By using the Service, you confirm you have reviewed and agree to the Privacy Policy.
You retain ownership of your uploaded data. By submitting data, you grant WattsIT Analytics a licence to:
- Process it to deliver your Energy Hub dashboard, or monitoring service
- Perform tariff simulations and pricing comparisons
- Generate quarterly updates where applicable
- Improve and develop the Service, including the use of anonymised or aggregated datasets
Anonymised data may be used for research, model development, or market insights as outlined in the Privacy Policy.
5. Service Modifications and Availability
We may modify, suspend, or discontinue any feature of the Service at any time. We do not guarantee continuous or error-free operation and are not responsible for outages caused by hosting providers, integrations, suppliers, or third-party systems.
6. Disclaimers
The Service is provided "as is" and "as available."
We do not guarantee:
- That analytics, forecasts, savings estimates, or tariff comparisons will be accurate, complete, or reflect future conditions
- That analysis results will lead to financial savings
- That supplier quotes will match final contract terms
- That all errors, inconsistencies, or anomalies in uploaded data will be detected
Energy costs depend on supplier decisions, business operations, market pricing, and future behaviours outside our control. All use is at your own risk.
7. Limitation of Liability
To the fullest extent permitted by Irish law, WattsIT Analytics, its founders, and its contractors are not liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, business interruption, opportunity, or goodwill
- Errors arising from inaccurate or incomplete data provided by you
- Decisions made by suppliers or third-party service providers
Our total liability, if any, is capped at €100 or the total amount paid by you in the previous 12 months, whichever is greater.
8. Termination
We may suspend or terminate access if you violate these Terms, misuse the Service, or if your use poses risk to our systems or other clients. On termination, your right to access the Service ends immediately.
Data will be handled as described in the Privacy Policy.
9. Governing Law
These Terms are governed by the laws of Ireland. Any disputes shall be resolved exclusively in the courts of Ireland.
